Wer über einen Internetmarktplatz Markenkleidung anbietet, die – anders als die Ware einiger Wettbewerber – nachweislich ordnungsgemäß in den Europäischen Verkehr eingeführt wurde und keine Rechte Dritter verletzt, darf ohne Wettbewerbsverstoß mit diesem Umstand werben und Käufern „garantieren“, dass es sich um Originalware handelt (Abgrenzung zu LG Bochum, 12 O 12/09 vom 12.02.2009).
