Eine Gebietskörperschaft kann mit einer von ihr vollständig kontrollierten Eigengesellschaft dann kein In-House-Geschäft abschließen, wenn die Gesellschaft nicht im Wesentlichen für die Gebietskörperschaft tätig ist.
