§ 5 a Abs. 2 UWG knüpft nicht an einen Irreführungstatbestand an, sondern beschreibt das Vorenthalten wesentlicher Informationen als eigenständigen Unlauterkeitstatbestand. Das Gesetz vermutet unwiderleglich, dass die Informationspflichtverletzung beim Kunden zu einer Fehlvorstellung führt und dass diese Fehlvorstellung sich auf die zu treffende Entscheidung auswirken kann.
